Will of John Rustull, Sr. - 1861

In the name of God, Amen. I John Rustull, Senr. of the County of Carteret and State of North Carolina, being of sound and perfect mind and memory, blessed be God, do, this twenty sixth day of July in the year of our Lord one Thousand eight hundred and thirty eight, make and publish this my last will and testament in manner following that is to say.

First, I give and bequeath unto my daughter Nancy at my death the sum of five dollars in money.

Item 2nd. I give and bequeath unto my John and Frances Longest, the two children of my daughter Sabra, the sum of twenty dollars to be expended by my son John Russell in schooling them.

Item 3rd. I give and bequeath unto my wife Hannah Rustull during her natural life only, the tract of land whereon I now reside, situated on the east side of Newport River and Rustull's Creek, containing one hundred and forty eight acres more or less. Also (for the term of her natural life) one mahogany breakfast table, one bed & furniture, half dozen flag chairs, one cow and calf, tow ewes & two lambs, one sow & pigs, and all the kitchen furniture.

Item 4th. I give and bequeath unto my son John Rustull and his heirs and assigns forever the whole of the tract of land above bequeathed to my wife during her natural life, to take full and entire possession of the same at her death, also all the other property given to my wife during her natural life, to take possession of the same at her death. I also give and bequeath unto the said John Rustull all the house hold furniture (including a burcan) all the cattle, hogs, sheep, and all the property of every description not mentioned before, that may remain on hand at my death, to him and his heirs and assigns forever.

And I hereby make and ordain my son John Rustull executor of this my last will and testament. In witness whereof I the said John Rustull Senr. have to this my last will and testament set my hand and seal the day and year above written.

Carteret County Court. Feb Term A.D. 1861

The foregoing paper writing purporting to be the last will and testament of John Rustull Senr. deceased is proved in open Court by the oath and examination of James Rumley and Henry Mace the subscribing witnesses thereto. It is therefore considered by the court that the said paper writing, and every part thereof, as the last will and testament of the said John Rustull Senr. deceased. And thereupon John Rustull the executor named in the will qualifying as such by taking the oath required by law. Ordered that said will be recorded and filed.
